| 内容記述 | かつては離婚した親は子どもと会うべきではないという風潮があったが、今日、離婚の増加に伴い、面接交渉が主張されるようになった。面接交渉権の権利性、性質には議論が多いが、「子の福祉」「子の最善の利益」を第一に考え、面接交渉権を認めたり、制限したりする考えに異論はない。いかなる場合に面接交渉権が制限されるのかを考察する。 | |||||

| 内容記述 | There used to be a tendency that divorced non was custodial parents should not have access to their. children. As divorce has been increasing in recent years, non custodial parents have increasingly insisted on rights of access. Here in lies problems concerning the rights of access. This paper discusses, who should have these rights, and the nature of these rights. Everyone is agreed that the first consideration should be the welfare of the child, and the interests of the child. This paper examines the situation when the welfare of the child restricts the right of access. | |||||
